The meeting was called to order by Mayor Tim Pogue at 7:02 p.m.

MINUTES

The Minutes of the from the November 12, 2018, Board of Aldermen meeting were submitted for approval. 

A motion was made by Alderman Fleming and seconded by Alderman Terbrock to approve the minutes from the November 12, 2018, Board of Aldermen meeting as submitted.  A voice vote was taken with a unanimous affirmative result and the motion passed.

The Minutes of the from the November 14, 2018 Special Meeting of the Board of Aldermen were submitted for approval.

A motion was made by Alderman Fleming and seconded by Alderman Stallmann to approve the minutes from the November 14, 2018 Special Meeting of the Board of Aldermen as submitted.  A voice vote was taken with a unanimous affirmative result and the motion passed.

PUBLIC COMMENTS

Dominic Lloyd, 688 Crowsnest Dr., requested the Board to consider passing an ordinance which would allow for backyard chickens in the City of Ballwin. Alderman Roach inquired as to which neighboring cities allows chickens. Mr. Lloyd stated he would provide a list to the Board with a slideshow at a later time through email.

LEGISLATION

BILL NO. 4010  AN ORDINANCE AMENDING THE 2018 BUDGET OF CASH REVENUE AND CASH DISBURSEMENTS FOR THE OPERATING, CAPITAL, TDD AND POST FUNDS OF THE CITY OF BALLWIN, ST. LOUIS COUNTY, MISSOURI, PROVIDING FOR EXPENDITURE REVISIONS IN ACCORDANCE WITH SAID BUDGET AND MAKING RE-APPROPRIATIONS THEREOF

A motion was made by Alderman Fleming and seconded by Alderman Leahy for a first reading of Bill No. 4010, title only.  A voice vote was taken with a unanimous affirmative result and Bill No. 4010 was read for the first time.

A motion was made by Alderman Fleming and seconded by Alderman Leahy for a second reading of Bill No. 4010, title only.  A voice vote was taken with a unanimous affirmative result and Bill No. 4010 was read for the second time.

A roll call vote was taken for passage and approval of Bill No. 4010 with the following results: 

Ayes – Aldermen Fleming, Leahy, Finley, Stallmann, Kerlagon, Roach, Bullington, Terbrock;
Nays -- None. 
Bill No. 4010 was approved and became Ordinance No. 18-15

RESOLUTION  A RESOLUTION AUTHORIZING THE MAYOR OF THE CITY OF BALLWIN, MISSOURI, ON BEHALF OF THE CITY, TO EXECUTE AN EMPLOYEE RECRUITMENT CONTRACT

A motion was made by Alderman Roach and seconded by Alderman Stallmann to approve the resolution which would authorize the Mayor to execute an employment recruitment contract on behalf of the City of Ballwin.  A voice vote was taken with a unanimous affirmative result and the Resolution passed.

RESOLUTION  A RESOLUTION AUTHORIZING THE MAYOR OF THE CITY OF BALLWIN, MISSOURI, ON BEHALF OF THE CITY, TO EXECUTE A CONTRACTUAL EMPLOYMENT AGREEMENT

A motion was made by Alderman Roach and seconded by Alderman Stallmann to approve the resolution which would authorize the Mayor to execute a contractual employment agreement on behalf of the City of Ballwin.  A voice vote was taken with a unanimous affirmative result and the Resolution passed.

MAYOR’S REPORT

Mayor Pogue announced that City Administrator Eric Hanson has resigned and former, retired, City Administrator, Bob Kuntz, will serve as Interim City Administrator during the search.

CITY ATTORNEY’S REPORT

Fire Pit Ordinance

City Attorney Jones presented draft legislation in response to recent discussions about fire pits. If approved, the legislation would amend the code with respect to the definitions of “structure” and “accessory structure.” 

A motion was made by Alderman Stallmann and seconded by Alderman Fleming to present the Fire Pit Ordinance at the next meeting for passage.  A voice vote was taken with the following results:

Ayes -- Alderman Stallmann

Nays -- Aldermen Terbrock, Finley, Roach, Fleming, Leahy, Bullington, Kerlagon

The motion failed due to the lack of majority votes.  

Show-Me Courts Ordinance

City Attorney Jones stated the Ballwin Municipal Court has set January 24, 2019, as the “go live” date for Show-Me Courts. Legislation was drafted due to changes in the court process. This draft ordinance would allow for the revision of municipal court costs schedule and authorize the execution of the Show-Me-Courts agreement.

A motion was made Alderman Stallmann and seconded by Alderman Bullington to present the Show-Me Courts Ordinance at the next meeting for passage. A voice vote was taken with a unanimous affirmative result and the motion passed.

Tanko

City Attorney Jones provided an update regarding a contract with Tanko. This is in regards to initiating contact and negotiating the acquisition of street lights from Ameren Missouri. More discussion will follow at later meetings.

ALERMANIC COMMENTS

Alderman Leahy asked for an update on leaves.  Jim Link stated crews currently have 384 streets out of 408 streets completed. He anticipates there will still be several more pick-up rounds.

Alderman Finley stated he was approached by a resident in Ward one that staff consider asking the crews that do the leaf pick-ups to see if they have any suggestions on how to streamline the process.

A motion was made by Alderman Fleming and seconded by Alderman Terbrock to adjourn the Board of Aldermen Meeting.  A voice vote was taken with a unanimous result, and the meeting was adjourned at 7:41 p.m.
