NOTE: Due to ongoing City business, all meeting agendas should be considered tentative. Additional issues may be introduced during the course of the meeting. CLOSED SESSION: Pursuant to Section 610.022 RSMo., The Board of Aldermen could, at any time during the meeting, vote to close the public meeting and move to closed session to discuss matters relating to litigation, legal actions, and/or communications from the City Attorney, as provided under Section 610.021(1) RSMo., and/or personnel matters under Section 610.021(13) RSMo., and/or employee matters under Section 610.021(3) RSMo., and/or real estate matters under Section 610.021(2) or other matters as permitted by Chapter 610. Meeting MinutesTHE MINUTES ARE PREPARED IN SUMMARY TO REFLECT THE OVERALL DISCUSSIONS,NOT VERBATIM QUOTES. The meeting was called to order by Mayor Pogue at 7:00 p.m. Roll Call PRESENT ABSENT Mayor Tim Pogue The Pledge of Allegiance was given. Mayor Pogue asked that there be a moment of silence to remember a Ballwin resident, Staff Sergeant Sean Devoy, who was killed during a training exercise in Fort Hood, Texas on September 12, 2017. Staff Sergeant Devoy served three tours in Afghanistan and was laid to rest on September 25, 2017. MINUTESThe Minutes of the September 11, 2017 Board of Aldermen meeting minutes were submitted for approval. Alderman Roach asked to amend the September 11, 2017, minutes in the second motion for the reading of Bill 3970 to change the first motion to show Alderman Fleming made the first motion. A motion was made by Alderman Roach and seconded by Alderman Terbrock to amend the second motion made by Alderman Terbrock to Alderman Fleming in the reading of Bill 3970 in the September 11, 2017 Board Meeting Minutes. A motion was made by Alderman Fleming and seconded by Alderman Terbrock to approve the September 11, 2017 Board of Aldermen meeting minutes. A voice vote was taken with a unanimous affirmative result and the motion passed. The Minutes of the September 11, 2017 Board of Aldermen Closed Session meeting minutes were submitted for approval. A motion was made by Alderman Fleming and seconded by Alderman Kerlagon to approve the September 11, 2017 Closed Session meeting minutes as presented. A voice vote was taken with a unanimous affirmative result and the motion passed. CITIZEN COMMENTSLynn Goetz, 504 Kenilworth Lane, commented that he is opposed to the City passing legislation on the regulation of beehives which are not causing a problem Olivia Pieknik, 385 Walnut Point Court, addressed the Board on behalf of the Holy Infant Ladies Auxiliary Council 10794. The Ladies wished to express their appreciation to Chief Scott, his Police Officers, and Dispatchers for the courtesy extended to them during their visit on Tuesday, September 19, 2017. She stated everyone enjoyed visiting with the department. County Councilman Mark Harder, addressed the Board in regards to the City/County Merger. He thanked the Board for bringing forth this Resolution. NEW BUSINESSLEGISLATIONBILL NO. 3973 Beekeeping Regulation A motion was made by Alderman Fleming and seconded by Alderman Terbrock for a first reading of Bill No. 3973. A voice vote was taken with a unanimous affirmative result and Bill No. 3973 was read for the first time A motion was made by Alderman Fleming and seconded by Alderman Kerlagon for a second reading of Bill No. 3973. A voice vote was taken with a unanimous affirmative result and Bill No. 3973 was read a second time. A roll call vote was taken for passage and approval of Bill No. 3973 with the following results: Ayes – Aldermen Fleming, Kerlagon, Finley, Bullington; Nays – Aldermen Roach, Terbrock, Stallmann, Leahy; Mayor Pogue cast the deciding vote, voting Nay. Bill No. 3973 Failed RESOLUTION St. Louis County / St. Louis City Merger Mayor Pogue stated his opinion is that small government is the best government; it’s more transparent and better serving to their residents. Alderman Stallmann added that the fate of the city should be decided upon by the people who it is affecting and not by someone in another city. Alderman Fleming read the following title of the resolution aloud: A RESOLUTION URGING THE ST. LOUIS COUNTY COUNCIL AND ST. LOUIS BOARD OF ALDERMEN TO OPPOSE ANY AND ALL LEGISLATION AUTHORIZING A STATEWIDE VOTE REGARDING OR MANDATING A CHANGE IN THE GOVERNMENT STRUCTURE OF ST. LOUIS CITY AND ST. LOUIS COUNTY AND THE MUNICIPALITIES THEREIN. A motion was made by Alderman Fleming and seconded by Alderman Kerlagon to pass the Resolution. A voice vote was taken for the passage of the Resolution with an affirmative result. Mayor Pogue asked that staff send this resolution be sent to the State Representatives and State Senators who represent the City of Ballwin. MAYOR’S REPORTMayor Pogue stated he is once again on the Municipal League Legislative Affairs Committee. He stated they are finalizing the policy statements for the year and once they are finalized he will distribute them to the Board. CITY ADMINISTRATOR’S REPORTCity Administrator Hanson provided a rendering of the City Hall floor plan for the Board to review. STAFF REPORTBallwin Life Magazine RFP – Staff recommended that Board award the bid to the second lowest bidder, A Graphic Resource. Staff had reached out to the first-lowest, Graphic Innovations, LLC, to request references, or samples of past printing jobs of any size but had not received any of the items requested. Staff added that they have worked with A Graphic Resource in the past on various printing jobs, and it has a respected reputation as a high-quality print service with the full ability to handle the job of printing and distributing Ballwin Life. Alderman Roach asked if Graphic Innovations was not qualified to complete the work. Staff stated they had not received any proof that they are capable or have the experience to complete a project similar to the Ballwin Life Magazine. A motion was made by Alderman Roach and seconded by Alderman Terbrock to accept staff recommendation and award the contract to A Graphic Resource who had the second low bid. A voice vote was taken with a unanimous affirmative result and the motion passed. North Pointe Pool Project – Design Build – Staff recommended the Board approve a design build process for the construction of a new splash pad and play structure to replace bucket falls. The project is contingent upon receipt of a Parks Grant in the Fall, which looks likely. In order to prevent the building of the play structure to overlap into the summer pool season, staff stated a design build process would likely allow the project to move forward this fall/winter and be completed prior to the opening in May 2018. Alderman Fleming stated that it appeared that the splash pad area would be substantially bigger than the current splash pad and require additional plumbing work, which would ultimately increase the expense of the project. Ms. Bruer stated they would expand the splash pad area and additional plumbing work would have had to be done, but the final design was not to the scale that was presented originally and the cost would be less because of reduced footprint. Ms. Bruer will provide a copy of the rendering of the play structures that was submitted for the grant. Mayor Pogue stated this project fits the criteria well for utilizing a design build due to the tight timeline. A motion was made by Alderman Stallmann and seconded by Alderman Bullington to accept staff recommendation and have staff move forward with a design build of the North Pointe pool. A voice vote was taken with a unanimous affirmative result and the motion passed. ALDERMANIC COMMENTSAlderman Fleming thanked the Police Department for working together during the protests in St. Louis. He stated this is one more example that shows that the City and County are capable of working well together. Alderman Stallmann also thanked the Police Department and added that it’s good to see that our officers were there and that he’s very appreciative of them. A motion was made by Alderman Fleming and seconded by Alderman Terbrock to adjourn the Board of Aldermen Meeting.
