MINUTES

The Minutes of the April 10, 2017 Board of Aldermen meeting minutes were submitted for approval. 

A motion was made by Alderman Fleming and seconded by Alderman Terbrock to approve the March 27, 2017Board of Aldermen meeting minutes as presented.  A voice vote was taken with a unanimous affirmative result and the motion passed.

 

PRESENTATION

Swear-in of Elected Officials

The honorable judge Virginia Nye swore in Mayor Pogue, Alderman Jimmy Terbrock, Alderman Mark Stallmann, Alderman Jim Leahy, and Alderman Ross Bullington.

Mayor Pogue proclaimed April 30th through May 6, 2017 is National Small Business Week. He signed a Small Business Week Proclamation and encouraged everyone to support small businesses in Ballwin.

Police Department Report – Chief Scott presented a slideshow to the Board that reported the Police Department’s activities and crime rates in 2016.

 

Because of the swearing of the re-elected officials, Roll Call was taken again.

OLD BUSINESS

BILL NO. 3958PERMIT ESCROWS

A motion was made by Alderman Fleming and seconded by Alderman Stallmann for a second reading of
Bill No. 3958.  A voice vote was taken with a unanimous affirmative result and Bill No. 3958 was read a second time.

A roll call vote was taken for passage and approval of Bill No. 3958 with the following results: 

Ayes – Aldermen Fleming, Stallmann, Finley, Kerlagon, Roach, Terbrock, Bullington, Leahy;
Nays -- None. 
Bill No. 3958 was approved and became Ordinance No. 17-11        

 

BILL NO. 3959 UNLAWFUL ENTRY INTO A VEHICLE

A motion was made by Alderman Fleming and seconded by Alderman Finley for a first reading of
Bill No. 3959.  A voice vote was taken with a unanimous affirmative result and Bill No. 3959 was read for the first time

A motion was made by Alderman Stallmann and seconded by Alderman Terbrock for a second reading of
Bill No. 3959.  A voice vote was taken with a unanimous affirmative result and Bill No. 3959 was read a second time.

A roll call vote was taken for passage and approval of Bill No. 3959 with the following results:

Nays -- None.

NEW BUSINESS

LEGISLATION

BILL NO. 3960 CONFLICT OF INTEREST

A motion was made by Alderman Fleming and seconded by Alderman Finley for a first reading of
Bill No. 3960.  A voice vote was taken with a unanimous affirmative result and Bill No. 3960 was read for the first time.

Alderman Terbrock recalled passing this bill a couple of years ago.
City Administrator Hanson stated this is something the state requires to be passed and filed with them at least every two years.

A motion was made by Alderman Fleming and seconded by Alderman Kerlagon for a second reading of
Bill No. 3960.  A voice vote was taken with a unanimous affirmative result and Bill No. 3960 was read a second time.

A roll call vote was taken for passage and approval of Bill No. 3960 with the following results: 

Ayes – Aldermen Fleming, Terbrock, Stallmann, Roach, Kerlagon, Bullington, Leahy, Finley;
Nays -- None. 
Bill No. 3960 was approved and became Ordinance No. 17-13        

 

RESOLUTION REINKE ROAD RE-ALIGNMENT

A motion was made by Alderman Stallmann and seconded by Alderman       Bullington for approval of the resolution to authorize the Mayor to execute the Sterling Company contract for Reinke Road engineering services. The City of Ballwin and the City of Ellisville have agreed to contract with and pay for engineering services for a re-alignment of Reinke Road each covering 50% of the cost.

 

BILL NO. 3961  SALES TAX HOLIDAY

This bill is only necessary if the City desires to opt-out of the sales tax holiday.
There was no reading of Bill 3961. Ballwin will continue to participate in the sales tax holiday.

 

CONSENT ITEMS

Budgeted items which are low bid and do not exceed expenditure estimates and/or
items which have been previously approved in concept.

A motion was made by Alderman Roach and seconded by Alderman Bullington to accept the Consent Items.  A voice vote was taken with a unanimous affirmative result and the motion passed.

Alderman Fleming asked that in future, in regards to items C and D, notification regarding meetings about these kinds of contracts be given to the Mayor, Chairman or members of the Public Safety Committee, in case they would like to attend.

 

MAYOR’S REPORT

Mayor Pogue recommended re-appointing Alderman Frank Fleming as the Chairman of the Board.

A motion was made by Alderman Bullington and seconded by Alderman Stallmann to re-appoint Alderman Frank Fleming as the Board’s Chairman.  A voice vote was taken with a unanimous affirmative result and the motion passed.

Mayor Pogue recommended committees remain as they were assigned last year since no changes to the Board were made as a result of the election. He also recommended Ray Kerlagon continue to serve of the Planning and Zoning Commission.

A motion was made by Alderman Bullington and seconded by Alderman Kerlagon to keep the committees as they were assigned in 2016 and to re-appoint Ray Kerlagon to serve on the Planning and Zoning Commission.  A voice vote was taken with a unanimous affirmative result and the motion passed.

Saturday, April 29th the Police Department is hosting a Drug Take Back event between 10:00 a.m. and 2:00 p.m.

The Drug Task Force will be meeting on May 2nd at 1:30 p.m. Anyone who is interested in attending should contact Mayor Pogue.

CITY ADMINISTRATOR’S REPORT

City Administrator Hanson announced that the longest tenured employee of Ballwin, Jerry Klein, will be retiring on Friday.

Letters went out to trustees about the HOA meeting on May 15th. Staff has already received feedback and expects a decent turn out.

Phase one with Navigate has been completed and they will present their findings at the next meeting.

City Administrator Hanson stated that he and Assistant City Administrator/Director of Economic Development Andy Hixson went to Jefferson City to speak with Ballwin’s legislators. He said the response they received was positive and everyone was very complimentary on them being there.

City Administrator Hanson has been receiving a lot of complaints about signs being posted around Ballwin illegally and asked if the Board had any objection to removing the signs and giving the offender one chance to retrieve the signs once the city removes them. There was no objection.

City Administrator Hanson stated the Clarkson Valley will be meeting on Tuesday and the city should find out who has won the proposal for the police contract. He would provide an update to the Board when the decision has been made.

CITY ATTORNEY’S REPORTS

Attorney Jones stated there may be a lawsuit against telecommunications companies for failing to report VOIP charges. This could turn into a class action lawsuit.

A motion was made by Alderman Terbrock and seconded by Alderman Stallmann to authorize the mayor to sign a contract with Attorney Jones’ law firm to start an informal discussion regarding the failure to report VOIP charges from telecommunications companies.  A voice vote was taken with a unanimous affirmative result and the motion passed.

Attorney Jones stated Historical Commission member Berna Arnold is on Hospice and if anyone would like information to contact her to contact him.

ALDERMANIC COMMENTS

Alderman Bullington Ballwin days is quickly approaching on June 8, 9, 10 and 11th. There will be fireworks and a parade. He is looking forward to all the aldermen, who represent the City, waving to all the participants along the parade route.

Alderman Stallmann stated the movie in the park was cancelled and asked if it had been rescheduled. Parks and Recreation director Linda Bruer stated it had yet to be rescheduled.

Alderman Finley in addition to the drug take back, there is also the shred event taking place in target’s parking lot on Saturday from 9 a.m. to 11 a.m. 

Alderman Terbrock asked Mr. Hixson what the population was of Manchester. Mr. Hixson stated the population is around 18,000.

 

A motion was made by Alderman Fleming and seconded by Alderman Finley to adjourn the Board of Aldermen Meeting.  A roll call vote was taken with a unanimous result, and the meeting was adjourned
 at 8:00 p.m.
