Meeting MinutesMINUTES OF THE BOARD OF ALDERMEN MEETING CITY OF BALLWIN – 300 Park Drive April 10, 2017
THE MINUTES ARE PREPARED IN SUMMARY TO REFLECT THE OVERALL DISCUSSIONS, NOT VERBATIM QUOTES.
The meeting was called to order by Mayor Pogue at 7:00 p.m. Roll Call PRESENT ABSENT Mayor Tim Pogue The Pledge of Allegiance was given. MINUTESThe Minutes of the March 27, 2017 Board of Aldermen meeting minutes were submitted for approval. A motion was made by Alderman Fleming and seconded by Alderman Kerlagon to approve the March 27, 2017Board of Aldermen meeting minutes as presented. A voice vote was taken with a unanimous affirmative result and the motion passed. The Minutes of the March 27, 2017 Board of Aldermen Closed Session meeting minutes were submitted for approval. A motion was made by Alderman Fleming and seconded by Alderman Kerlagon to approve the March 27, 2017Board of Aldermen Closed Session meeting minutes as presented. A voice vote was taken with a unanimous affirmative result and the motion passed.
OLD BUSINESSBILL NO. 3946 CONTRACT FOR ELECTRICITY AND LIGHTING FACILITIES Alderman Roach asked if a 20 year contract was standard for Ameren. City Attorney Jones stated it is standard for Ameren and added that the 5M and 6M tariff’s attached to the bill extends the discount to municipal customers. Alderman Terbrock asked if there was a termination provision in the contract in the instance the City wanted to install and maintain their own street lights but still purchase power through Ameren. City Attorney Jones stated there was a clause in the 5M tariff that would charge $100 per light post to be removed should the City wish to install and maintain their own fixtures. Alderman Roach asked if there was something in the contract that would allow for the City to transition into replacing and maintaining fixtures instead of doing it all at once. City Attorney Jones stated the post or fixture would just be deleted from Ameren’s list if that were the case. Alderman Fleming asked why Ameren hasn’t been pushing Ballwin for a response since this process seems to have been prolonged. City Attorney Jones stated Ameren has been contacting not only Ballwin but other cities as well advising that if the city doesn’t enter into a new lighting contract they would not be extending the municipal discount any longer. Alderman Kerlagon asked if anyone had seen where companies bid out contracts for electric and then bill to the users. City Administrator Hanson stated that when he was in Monmouth, IL they bid out electrical contracts at significantly lower rates. Alderman Roach asked about the right to install company facilities in paragraph three, if the City needed to have any provisions to address the status of the streets before and after the work. City Attorney Jones stated this provision is already provided for in the City’s Right-of-Way Ordinance.
A motion was made by Alderman Fleming and seconded by Alderman Stallmann for a second reading of A roll call vote was taken for passage and approval of Bill No. 3946 with the following results: Ayes – Aldermen Fleming, Terbrock, Stallmann, Roach, Kerlagon, Leahy, Finley, Bullington; NEW BUSINESSLEGISLATION BILL NO. 3959 UNLAWFUL ENTRY INTO AN AUTOMOBILE A motion was made by Alderman Bullington and seconded by Alderman Fleming for a first reading of Alderman Fleming asked if something for automobiles could be added to the Trespassing section of the Code of Ordinances. He added that it’s hard to gauge the intent for committing a crime until something is actually taken. He stated it would be nice to have a memo from the Prosecuting Attorney explaining what he is hoping to accomplish with the passing of this ordinance. He would like additional information. City Administrator Hanson stated that it would not be an issue to hold off on this bill to get additional information from the Prosecuting Attorney. This Bill was held over for further information.
CONSENT ITEMSBudgeted items which are low bid and do not exceed expenditure estimates and/or
Alderman Roach asked how prices were gathered for the acquisition of the easement. Public Works Director Gary Kramer stated that MoDOT has preapproved O.R. Colan Associates as a contractor for easement acquisition. Alderman Roach asked if there would be potential saving to receive more bids on this project. Mr. Kramer stated that he didn’t know if there would be any cost savings but added that there are certain regulations on how to appraise land and certain qualifications to make sure the acquisition is done right and all requirements are met to qualify for federal grants. A motion was made by Alderman Fleming and seconded by Alderman Bullington to accept the Consent Items. A voice vote was taken with a unanimous affirmative result and the motion passed.
MAYOR’S REPORT Mayor Pogue reminded the Board that there is an MSD meeting at the Pointe from 6:30 p.m. – 8:30 p.m. on Tuesday, April 11th. Mayor Pogue stated this is National Public Safety Tele-Communicators week and wished to recognize and thank the Ballwin dispatchers for their hard work and for being there 24/7 to answer the call when needed. Thanked staff who helped at the Tons of Trucks event on Saturday. He said the event was a success and had a great turn out.
CITY ADMINISTRATOR’S REPORT Ruppel Farms Project: The City is working with Ellisville in regards to a number of complaints about Reinke Road. Ellisville will be handling the preliminary engineering agreement portion of this project. A Banner Committee has met to begin the process of selecting and installing banners along Manchester Road. May 22nd the Parks & Recreations Department is hosting a movie in the park event. The movie will be played in Vlasis Park and all are encouraged to come. Monday, May 15th the City will host an HOA meeting. Additional information will be provided to the Trustees and Board members for location and time at a later date.
ALDERMANIC COMMENTSAlderman Kerlagon thanked City Administrator Hanson and Public Works for their quick response to a situation that was brought up by a resident in Ward four.
A motion was made by Alderman Fleming and seconded by Alderman Terbrock to adjourn the Board of Aldermen Meeting. A roll call vote was taken with a unanimous result, and the meeting was adjourned
