CLOSED SESSION: Pursuant to Section 610.022 RSMo., The Board of Aldermen could, at any time during the meeting, vote to close the public meeting and move to closed session to discuss matters relating to litigation, legal actions, and/or communications from the City Attorney, as provided under Section 610.021(1) RSMo., and/or personnel matters under Section 610.021(13) RSMo., and/or employee matters under Section 610.021(3) RSMo., and/or real estate matters under Section 610.021(2) or other matters as permitted by Chapter 610. Meeting MinutesMINUTES OF THE BOARD OF ALDERMEN MEETING CITY OF BALLWIN – 300 Park Drive October 24, 2016 THE MINUTES ARE PREPARED IN SUMMARY TO REFLECT THE OVERALL DISCUSSIONS, NOT VERBATIM QUOTES. The meeting was called to order by Mayor Pogue at 7:10 p.m. Roll Call PRESENT ABSENT Mayor Tim Pogue The Pledge of Allegiance was given.
MINUTESThe Minutes of the October 10, 2016 Board of Aldermen Budget Session meeting minutes were submitted for approval. A motion was made by Alderman Fleming and seconded by Alderman Roach to approve the October 10, 2016Board of Aldermen Planning Session meeting minutes as presented. A voice vote was taken with a unanimous affirmative result and the motion passed. The Minutes of the October 10, 2016 Board of Aldermen meeting minutes were submitted for approval. A motion was made by Alderman Fleming and seconded by Alderman Kerlagon to approve the October 10, 2016Board of Aldermen meeting minutes as presented. A voice vote was taken with a unanimous affirmative result and the motion passed. NEW BUSINESSLEGISLATION BILL NO. 3941 S.U.E. FOR TEXAS ROADHOUSE A motion was made by Alderman Fleming and seconded by Alderman Leahy for a first reading of Alderman Leahy asked when the restaurant planned to open. Paul Phillips, a representative from Greenberg Ferrell, on behalf of Texas Roadhouse, stated the restaurant is looking to open in the spring of 2017. A motion was made by Alderman Fleming and seconded by Alderman Terbrock for a second reading of A roll call vote was taken for passage and approval of Bill No. 3941 with the following results: Ayes – Aldermen Fleming, Terbrock, Finley, Bullington, Kerlagon, Roach, Leahy, Stallmann; Nays -- None. CONSENT ITEMSBudgeted items which are low bid and do not exceed expenditure estimates and/or E-CITATION IMPLEMENTATION This item was pulled by staff to address a change in the purchasing policy. CITY ADMINISTRATOR’S REPORTLeaf pick-up began on Monday, October 24. There are seven crews out collecting leaves throughout the City. Route maps will be updated at the end of each business day on the website to illustrate the progress of leaf collection. Thursday, October 27, at 6:30 p.m., Jay Wolfe Toyota will be unveiling a van for Officer Mike Flamion. City Administrator Hanson encouraged everyone to attend if they are available. STAFF REPORTSPARKS & RECREATION FEES To keep pace with rising operating costs and customer requests, staff is recommending several changes to park and recreation facility admission fees. Membership fees have not been adjusted for ten years. Ms. Bruer provided an outline of fees for the Board to review and consider. CITY ATTORNEY’S REPORTSCity Attorney Jones suggested a short discussion to take place in closed session regarding litigation.
Mayor Pogue announced that Pursuant to Section 610.021 [1] RSMo, the board will meet in closed session regarding litigation. Adjourn to Closed Session: A motion was made by Alderman Stallmann and seconded by Alderman Bullington to adjourn to closed session to discuss litigation. A roll call vote was taken with the following results: Ayes: Aldermen Terbrock, Finley, Roach, Stallmann, Fleming, Leahy, Bullington, Kerlagon Nays: None The motion passed to adjourn to closed session at 7:31 p.m.
The Board reconvened in open session at 7:54 p.m. Reconvene to Open Session: A motion was made by Alderman Fleming and seconded by Alderman Leahy to reconvene to open session. A voice vote was taken with a unanimous affirmative result and the motion passed. Mayor Pogue reconvened the open session.
ALDERMANIC COMMENTSAlderman Fleming stated there will be a Finance and Administrative Committee meeting prior to the next Board, November 14th, meeting at 6:30 PM. Topics are still to be determined but it will be over short topics to get. A motion was made by Alderman Fleming and seconded by Alderman Leahy to adjourn the Board of Aldermen Meeting. A roll call vote was taken with a unanimous result, and the meeting was adjourned
