Jeff Reeves, 109 Lincoln: He said the developer wouldn't negotiate. They went to court, and there was a commissioner's award. Regency Development called him and said they would leave him there alone unless he reduced what he was awarded, they would work around him. Where were they a year ago when they were trying to work it out? Mayor Jones said since Mr. Reeves is involved in litigation to which the City is a party, therefore, this cannot be discussed in open meeting. He asked for police protection for his employees and property.

BILL NO. 3045- AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF BALLWIN AND AMENDING CHAPTER 14 THEREOF ARTICLE VIII ENTITLED 'RIGHTS-OF-WAY USAGE."

A motion was made by Alderman Nichols and seconded by Alderman Buermann for a first reading of Bill No. 3045. A voice vote was taken with an affirmative result and the motion was declared passed. Bill No. 3045 was read for the first time.

A motion was made by Alderman Easter and seconded by Alderman Byatt for a second reading of Bill No. 3045. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Bill No. 3045 was read for the second time.

A roll call was taken for passage and approval of Bill No. 3045 with the following results: Ayes - Byatt, Buermann, Easter, Nichols, Robinson, Suozzi. Nays - None. Whereupon Mayor Jones declared Bill No.3045 approved and it became Ordinance No. 00-52.

BILL NO. 3046 -AN ORDINANCE AMENDING THE 2000 BUDGET OF CASH REVENUE AND CASH DISBURSEMENTS FOR THE OPERATING AND CAPITAL REVENUE FUNDS OF THE CITY OF BALLWIN, ST. LOUIS COUNTY, MISSOURI, PROVIDING FOR EXPENDITURE REVISIONS IN ACCORDANCE WITH SAID BUDGET AND MAKING RE-APPROPRIATIONS THEREOF.

A motion was made by Alderman Robinson and seconded by Alderman Buermann for a first reading of Bill No. 3046. A voice vote was taken with an affirmative result and the motion was declared passed. Bill No. 3046 was read for the first time.

Mayor Jones said that there is a re-appropriation suggested within the capital budget to reapply $18,000 originally earmarked for street lights. It was not used because bids were much higher than expected given a change in AmerenUE's policy. This affects two of the older neighbor- hoods in ward 3, Claymont and Oak Tree Farm. These are areas that have petitioned the City and did so in a timely fashion. He is only in favor of re-appropriating this particular amount of money with the understanding that we will promptly talk to AmerenUE, get them to reconfigure the grid if necessary so that we can get going, particularly on Iron Lantern, Claymont Drive, Country Club Drive, major thoroughfares in the City. They have been waiting a long time. We told them we were going to do it in the year 2000. We need to get it done as soon as possible. 

A motion was made by Alderman Nichols and seconded by Alderman Buermann for a second reading of Bill No. 3046. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Bill No. 3046 was read for the second time. 

A roll call was taken for passage and approval of Bill No. 3046 with the following results: Ayes - Robinson, Easter, Buermann, Byatt, Nichols, Suozzi. Nays - None. Whereupon Mayor Jones declared Bill No.3046 approved and it became Ordinance No. 00-53. 

CONSENT ITEMS 

CHEMICAL STORAGE: It is recommended that a chemical storage building be purchased from Securall, who submitted the lowest of 3 bids in the amount of $15,388. 

SALT: It is recommended that we purchase our 2000-01 salt allocation from low bidders IMC Salt and Lange Slegmann Hauling. 

There was no discussion on these items. A motion was made by Alderman Buermann and seconded by Alderman Suozzi to approve the Consent Items. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. 

REPORT OF THE MAYOR 

None. 

REPORT OF THE CITY ADMINISTRATOR 

Pointe Program Fees: City Administrator Kuntz said it is recommended that the City increase the cost for the use of The Pointe for lock-ins. These are labor intensive events and is not priced on a competitive basis. 

City Attorney Lucchesi said it will take a motion to draft an ordinance. A motion was made by Alderman Nichols and seconded by Alderman Easter to draft an ordinance. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. 

Sewer Lateral Insurance: City Administrator Kuntz said this is the recommendation from the Public Works Committee to establish limitations for future payment of claims under the sewer lateral insurance repair program. The committee felt there were no win-win solutions. Whatever changes were implemented, somebody would feel slighted. The demand has exceeded the revenue generated by the $28 state-imposed tax limit. Unless action is taken, we will have such a long waiting list that no one will be served. Alderman Nichols said that what is being proposed is that those who are now waiting will be treated outside of this proposal, without the $3,000 limitation. He stated further that any changes to the program should be effective immediately and not deferred until January 1. 

A motion was made by Alderman Robinson and seconded by Alderman Byatt to have City Attorney Lucchesi draft an ordinance consistent with the Klein memo of October 4, with the additional provision of the automatic forfeiture for parties who are no longer residents of the City of Ballwin, if they fail to properly advise the City of a forwarding address and mode of payment. A voice vote was taken with a unanimous affirmative result. The motion was declared passed.

Shared Recreational Facilities: City Administrator Kuntz said the City of Ellisville has asked if there is interest in a preferential rate for their residents for Pointe memberships. They would offer it to their residents, they collect it, they subsidize the difference which give Ballwin the
I 00% non-resident fee. They could use this to gauge the interest of their residents as a small investment as to justify a future capital expenditure of their own down the road. They like the concept but they don't want to pay the 100%. This would be a one-year program. Mayor Jones and the Board felt this would create good community relations as long as it didn't overcrowd the Pointe.

ALDERMANIC COMMENTS

Alderman Buermann said the developer in Claymont Place infringed upon the 40-foot setback by I or 2 feet, mostly because he changed the plans. In one case it was by 10 feet. Is there anything the City can do because anybody can go before the Board of Adjustment? Can they be find because the developer came into the infringement? Mayor Jones said that as part of the inspection process, once the footprint of the foundation has been established, we can require an as-built survey. Alderman Buermnann said that if anyone is going to do business in the City of Ballwin, they have a responsibility to the City.

A motion was made by Alderman Nichols and seconded by Alderman Easter to adjourn. The motion passed unanimously. The meeting was adjourned at 8:00 p.m.
