The Minutes of the April 23, 2001 Board of Aldermen meeting were submitted for approval. Alderman Suozzi said on Page 7, under Ward Boundaries, "Mayor Jones instructed these Aldermen"; should be "the" Aldermen. A motion was made by Alderman Suozzi and seconded by Alderman Buermann to approve the Minutes as amended. A voice vote was taken with a unanimous affirmative result and the motion was declared passed.
The Minutes of the April 23, 2001 Public Health & Safety Committee meeting were submitted for approval. A motion was made by Alderman Buermann and seconded by Alderman Boland to approve the Minutes. A voice vote was taken with a unanimous affirmative result and the motion was declared passed.

A motion was made
by Alderman Huddleston and seconded by Alderman Buermann to draft appropriate legislation for the next Board meeting. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Alderman Easter said the Board of Aldermen had no intention to prohibit the parking of pick up trucks or panel vans but it does want to limit the parking of special purpose vehicles, such as tow trucks and cement mixers. It was also discussed to allow the outdoor storage of up to two mowers in residential areas. Alderman Easter reported that at the 6:00 p.m., May 14 committee meeting, a motion was presented to recommend new legislation regulating the parking of trailers and commercial vehicles in the City of Ballwin. It was proposed to impose several parking restrictions and to limit trailer length according to the zoning classification.

Alderman McDowell asked if there is written evidence from the 90% of the residents opposed to the Enigma Lounge. Mr. Andershak said no, it was a voice vote.

Alderman Easter asked if Mr. Donohue attended Enigma with live music and without. He said he was there at both times and he stopped going when there wasn’t live music any longer.

Alderman Easter asked if there is a difference in the negative activity when there is live music compared to no live music. Mr. Peas said yes. When live music was present, he had to call the Police because of fighting, loud music, and traffic. Since the live music ended, these problems have not occurred.

: Mrs. Farr spoke in favor of Enigma and Dorianna Grillo. She said Dorianna goes above and beyond any other business she has seen in making sure everyone is taken care of. She’s trying to work with everyone in this situation. The lounge is very nice and has a good clientele.: Mr. Mason said Enigma opened in August. He said the nature of the business has changed and will change again.: Mr. Burke spoke in favor of Enigma and Doriana Grillo. He said he is 55 and visits the lounge with his 25-year old daughter, wife, 62-year old sister and 75 year old mother-in-law.: Mr. Peas said at the subdivision meeting, 90% of the attendees (30 households) voted against Enigma. He said UMB bank has had to post customer-only parking signs on the lot. This past weekend, he observed public urination. The security guard cannot see or prevent every unacceptable act. Valet parking will increase the loud talking and noise in the neighborhood.: He spoke in favor of Enigma. Mr. Stadneck said that as a physician, he comes home at various hours of the night. He has never seen anyone drunk. The security guard is a good idea. He has some of the same concerns as previously mentioned – traffic, speeding, children in the neighborhood, trash, however, he believes that the trash is not coming from Enigma. A DJ crowd would be a younger crowd and not as well-behaved. The live entertainment draws a more professional, upscale clientele.: He spoke in favor of Enigma. He believes that not having live entertainment will bring a poor-quality crowd.: He is opposed to trailers being parked in residential areas and feels that it reduces property values. His next door neighbor has a large two-trailer landscape service with several lawn mowers, and weed eaters. It is an unsightly component to his neighborhood.: Mr. Demski said he has lived at this location for over 30 years. He has over an acre, with two trailers, and the neighbors don’t mind his trailers being there. He pointed out that the ballpark behind his house has been "grand fathered" from noise and light issues because it has been there for many years. He feels he should also be "grand fathered" from the trailer and lawn mower issue because he has live there for 30 years. He said he can no longer work on his boat at his residence if it has been there over 24 hours. He pointed out that even though parking on grass is prohibited, Elco Chevrolet always has cars parked on the grass and at the Church behind the Chevrolet lot. He said there’s too much government telling people what they can and cannot do on their own property.: She said they have received a lot of phone calls and the lawn mower issue is a deterrent to small business. She suggested a business license/permit for the home businesses.: Mr. Donohue said he has attended Enigma since the opening. The cheap drinks and coupons started after the live entertainment ended. He spoke in favor of Enigma and the high quality of the patrons.: Mr. Singer spoke for Ann Childress, 914 Claybend Drive. He passed out packets of advertising that is being used by Enigma. He noted that discounted drink prices are promoted for Wednesday and Thursday. There is a track record of traffic problems from the bar. He suggested a shopping center would be a better location for Enigma than close to a subdivision.: She wants to keep Enigma in the neighborhood.: Mr. Krubs is in favor of Enigma. He enjoys being able to go only a block from his house and enjoy live entertainment.: Mr. Masatti supports the Enigma.: Mr. Snyder expressed his opposition to the Enigma Lounge. His house is the farthest from the lounge in his subdivision, but there has been damage to it since the lounge opened. Drivers cannot and will not be stopped by the security guard to determine if they are residents or patrons and future damage is a possibility. He spoke against Enigma because of his young daughter and the impact on the character of the neighborhood. He said that at the entrance to his subdivision there is a sign advertising the bar. This is not acceptable to him in his efforts to raise his daughter in a safe and alcohol-free environment. She said she is responsible for booking the bands for the Enigma Lounge. She spoke highly of Enigma and Doriana Grillo. Top quality bands from St. Louis are booked with a variety of dance music – not hard rock. She said Enigma was an entertainment lounge and bar with high quality clientele. He spoke in favor of the Enigma Lounge. He said he lives six houses away from Enigma Lounge and his property value has not gone down. Mr. Andershak said a majority of the subdivision residents were present at a meeting and a vote was taken. Over 90% of the residents present were against the Special Use Exception for the Enigma Lounge. Many residents believe that the petition was misrepresented to them when they signed it. He said a bar draws a different clientele than a banquet facility. Ms. Grillo said the lounge has been in operation since August 3, 2000. The concerns of the neighbors were parking, noise, and trash. She explained the steps she has taken to resolve the problems as follows: Mandatory valet parking, after the initial parking has been filled; the valet personnel will use the sidewalk behind the medical building to return, with the already-obtained permission from Dr. Stamnic; two security guards will be working on the weekend, one at Clayheath and Claybend, and the other patrolling the parking lot. She said the surrounding neighborhood knew this was commercially zoned when they bought their homes. Mr. Linton said he is the security guard for Enigma Lounge. The employees pick up the trash in the entire area of the lounge after closing. He said some of the trash is tossed by individuals in passing cars. She spoke against the valet parking for the Enigma Lounge. She said because the route designated for the valet employees is long and will encourage cutting through her yard. She said a nightclub will adversely affect the character of her neighborhood. She had signed the petition in favor of the Enigma Lounge, but has requested her name be withdrawn. Mr. Koslovsky referenced the information that was provided to the Aldermen from Doriana Grillo, Manager of the Enigma Lounge. He said the security service is a reputable bonded firm. There is a written acknowledgment from Paul Londe, owner of the Barn At Lucerne, allowing parking on his facility’s lot for valet parking. A mandatory valet system will be enforced. Once the Enigma parking lot is full, patrons would not be allowed to park anywhere else on their own. They would have to utilize the free valet service. They would not be allowed to leave the club and walk to their car on their own, thus walking through the subdivision. The valet employees would also have a designated route to walk back to the Enigma after parking the patron’s vehicle. He asked for a chance for six months to prove that the business can operate in a manner that does not negatively impact the area. Mr. Taylo asked if there is a legal issue with zoning based trailer length. City Administrator Kuntz said that allowing a certain length on larger lots and not on smaller lots is the issue. Ms. Schneider spoke about Subdivision Indentures. She said each subdivision should be responsible for paying for the enforcement of its own indentures.: He spoke to the Board regarding trailers and commercial vehicle definitions. He said that business use in homes is not negative, and according to real estate agents, does not affect property values.

LEGISLATION
BILL # 3092
Mayor Jones said this legislation was read once and tabled at the previous meeting. The Board considered this matter after a unanimous negative recommendation from the Planning and Zoning Commission. The Mayor noted that this request for a special use exception for Enigma Lounge for liquor-by-the-drink and live entertainment is not related to the continued operation of the present Enigma Lounge.
Alderman McDowell said he visited the Lounge. He said the Enigma is a clean and well kept establishment. He was impressed with the operation. He said it’s unusual to see so much proactive responses for a business. The clientele is well dressed, going out with their spouse at a club to hear live entertainment. He could not hear the music from surrounding properties. He has never seen in all of his years on the Zoning Commission anyone so willing to go to the lengths that Ms. Grillo has. Alderman McDowell said he supports the Enigma Lounge.
Alderman Suozzi asked the Aldermen who were on the Board in 1997 to recall the initial special use exception that was granted to Zhivago’s. Would the Board in 1997 have approved this petition?
Alderman Boland said the Enigma Lounge is not a bad idea, but unfortunately, is in the wrong place at the front door of a subdivision. He believes that it will adversely affect the character of the neighborhood. He was impressed with the large positive turnout in support of Enigma, but he doesnot believe that it can operate at this location without having a serious negative impact on the neighboring residential neighborhoods.
Alderman Robinson said he is troubled by the letter received from Mr. Hinchee about no agreement for Claymont Plaza parking. Mr. Koslovsky said Slava attempted to make this connection through Mr. Londe. It was decided, after the last meeting, that patrons crossing Clayton Road was not a good idea so this agreement was not pursued. There is no written parking agreement with UMB bank. There has been a verbal agreement in the past but never in writing.
Alderman Buermann asked if 12 cars pulled up at one time, how many runners will be available for valet parking. Doriana Grillo said 4. Alderman Buermann asked how they will know when the lot is full and the valet service will have to start. Ms. Grillo said there will be a sign stating "Mandatory Valet". There will be two employees with clickers. As cars come in, one clicker will count the cars as they come in, the other clicker will count as the cars leave in order to keep track of the 86 spaces available. Once the lot is full, the A-frame "Mandatory Valet" sign will be in place. She said there will never be a large multi-car backup.
Alderman McDowell asked what was the number of patrons in the facility at the time Enigma was being operated with live bands. Ms. Grillo said 220. Alderman McDowell asked how much additional parking was needed beyond the site parking at that time. Ms. Grillo said before the no-parking signs were put up, parking was allowed on the side street. They were also parking in the adjoining residential area. It was estimated that 25-50 cars were parked on the streets in addition to the 30 cars on the UMB Bank lot.
Alderman Nichols asked if the property owners who have granted permission for parking, could withdraw that permission at a later date. Ms. Grillo said the only written agreement is the letter provided by Mr. Londe. He could terminate this at any time. Mr. Londe is the landlord.
Alderman Robinson said he would like to have an upscale lounge in Ballwin. If managed properly, perhaps it could be a good neighbor with the subdivision. He said he has not visited the lounge and would like to give this more thought before a vote is taken.

Mayor Jones recommended a vote at this meeting, since the May 28 Board meeting is cancelled because of the holiday. He said a vote could not be taken for another four weeks, and one hour and 15 minutes of comments have been heard at this meeting.
Alderman Nichols asked how the petitioner feels about postponing the vote. Steve Koslovsky, representative for Enigma, said he doesn’t have anything else to bring to the Board. He agreed with Mayor Jones.

City Administrator Kuntz explained that this is necessary because of the establishment of the Development District. Under the Redevelopment Agreement, there needs to be a specifically designated disbursing agent in case of any legal challenge. The City Treasurer will serve in this capacity.

by Alderman Easter and seconded by Alderman Nichols to approve of the destruction of records from 1995 in accordance with State guidelines. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. – Cancelled checks and time sheets from 1995, in accordance with State guidelines.
REPORT OF THE MAYOR
Brookside Drive
Alderman Buermann said Brookside Lane is a substandard private street. Alderman Easter said several years ago the property owners were in favor of turning Brookside Land over if the City would bring the street up to standard. At that time, most of the residents were in favor of this. Some of the residents are still in favor of making Brookside Lane the only access to Ballwin Meadows Subdivision if access to Manchester Road is eliminated. If the Board decides to act on this plan, every resident in that area should be notified by mail and asked their opinion. Alderman Nichols said if the property owners won’t agree to vacate, it becomes a moot issue unless the City is prepared to use condemnation.
Alderman McDowell expressed concern that a single entrance to Ballwin Meadows Subdivision from Ries is worse than from Manchester. Alderman Huddleston believes that this is not the best time to open this access because of the construction traffic, but that two accesses are best.
Alderman Huddleston said this would not be the best time to open the access because Ballwin street repairs should be taken care of first before other street projects. If Brookside is opened to Ries Road, the other end at Manchester Road should not be closed.
Transportation Development District (TDD) Appointments
Board of Adjustment Appointment
– Mayor Jones said R. Jon Bopp was reappointed at the last meeting in error. The term expiration was that of Jean Shaw, Ward 3, instead of Mr. Bopp. A motion was made by Alderman Nichols and seconded by Alderman Buermann to reappoint Jean Shaw to a 5-year term of office. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. – Mayor Jones recommended the appointment of Glenda Loehr, with Robert Kuntz as the alternate. A voice vote was taken with a unanimous affirmative result and the recommendation was approved. – Mayor Jones suggested opening Brookside while Ries Road is under construction. If Brookside becomes a cut-through street, Lark Hill may have to be closed at Manchester Road.
REPORT OF THE CITY ADMINISTRATOR
Inspection Fee
Alderman Boland said this was previously placed before the residents on a ballot and it was voted down. Alderman Boland asked if this fee can be changed by the Board without a vote of the people. City Attorney Lucchesi said yes, if the increase corresponds with the cost of providing the service. City Administrator Kuntz said this is a cost recovery issue and not a revenue generator. He said he would like to see the Occupancy Permit fee be the same price for both multiple family and single family residences. The inspection fee should be greater because it’s twice the work to inspect a house as it is an apartment. An increase to cover 50% of the actual cost is suggested. Alderman Nichols said that by only charging 50% of the actual cost, the inspection of a seller moving out of the City is subsidized by the residents still living in the City. He disagreed with that principle and said the seller moving out of the City should pay the whole fee and not expect the current residents to help pay the fee. Assistant City Administrator Aiken said the actual total cost of a house inspection is $116, but the City presently charges $20.

by Alderman Boland and seconded by Alderman Nichols to invite the Ballwin Days Chairman to explain to the Board the reasons and details of his committee’s request to sell margaritas at the Ballwin Days festival. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. – The Board discussed the issue of allowing the sale of margaritas at the Ballwin Days festival. Alderman Easter reported that margaritas from a bar would have a higher alcohol content, but these will be like a beer in terms of alcohol content. Chief of Police Biederman said that he doesn’t think this is a good idea. Mayor Jones said this is to benefit the Marshal Faulk Foundation. Alderman Nichols suggested inviting the Ballwin Days Chairman to attend the next Board meeting to explain the details of this request. by Alderman Easter and seconded by Alderman Nichols to pay $1,200 to the property owner in exchange for the easement. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. – Alderman Easter said the resident will sign the easement if the trees are cut down. She suggested paying the resident $1,100 to cut down the trees plus $100 for the easement. City Administrator Kuntz agreed. – City Administrator Kuntz suggested this item be held over to the next meeting. by Alderman Easter and seconded by Alderman Buermann to accept the Parks Advisory Committee list as is, and to delete the third paragraph of the Committee Charge. – City Administrator Kuntz said all who have been recommended to serve on this committee have agreed to do so. Alderman Huddleston suggested that Carla Boring be substituted for Charlie Gatton, who is on the Planning and Zoning Commission. She worked on getting the sales tax passed and wrote articles for the Suburban Journal. Alderman Boland agreed. by Alderman Nichols and seconded by Alderman Robinson to consider the golf fees at the next Board of Aldermen meeting with a report on expenses for the past 3 years. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. – Alderman Buermann believes the green fees should not be raised right after the ½ cent parks tax was approved. by Alderman Robinson and seconded by Alderman Nichols to draft legislation to increase the single family inspection fee to $116. A roll call vote was taken as follows: Ayes: Suozzi, Robinson, Nichols, Easter. Nays: McDowell, Buermann, Boland, Huddleston. Mayor Jones cast the tie breaking vote: Mayor Jones, Nay. The motion failed 5-4.: City Administrator Kuntz recommended increasing the single family residential Occupancy and Inspection fee by ordinance to bring this fee into alignment with the costs of providing this service.

- Alderman Boland said he was approached by a representative from Gray Eagle Distributing. He said in years past, Gray Eagle was not invited to bid for the beer concession at Ballwin Days. City Attorney Lucchesi said a 4th class city has no obligation to do competitive bidding. – Alderman Easter asked if the ward redistricting will be completed by Ballwin Days. Mayor Jones said probably not. City Administrator Kuntz said information will be available at the next meeting to appoint the committee. Alderman Easter said Ed Montgomery has agreed to serve as the ward 1 representative on the Redistricting Committee. Alderman Boland added Richard Boerner for the committee, and Alderman Nichols also added Richard Anderson, Executive Director of the Danforth Foundation. by Alderman McDowell and seconded by Alderman Nichols to instruct the Police Department to study the Windcliffe locations for the possible installation of a 3-way stop. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. - Alderman McDowell said that at the intersections of Windcliffe with Portwind and Towercliffe, there are yield signs. There has been speeding in the area and some of the residents want 3-way stop signs at these locations. He said there are children in the area and the residents are concerned that they are in danger.

Whereupon Mayor Jones declared the motion failed (5-3). by Alderman Robinson and seconded by Alderman Nichols to table the Enigma Special Use Exception in order to have more time to consider the large number of comments, to visit the lounge, and consider more closely the parking problems. Alderman Buermann said he would like a firm commitment from Mr. Londe for the parking.n order to find in favor of the petitioner, this Board must find that the petition will not substantially increase traffic hazards or congestion, will not adversely affect the character of the neighborhood, will not adversely affect the general welfare of the community, will not over-tax public utilities, will not adversely affect public safety and health, and that the petition is consistent with good planning practice, the site can be operated in a manner that is not detrimental to the permitted developments and uses of the district, and can be developed and operated in a manner that is visually compatible with permitted uses in the surrounding area. - AN ORDINANCE GRANTING A SPECIAL USE EXCEPTION TO DORIANA GRILLO D/B/A ENIGMA LOUNGE FOR A RESTAURANT WITH CARRYOUT, LIQUOR BY THE DRINK AND LIVE ENTERTAINMENT.: Mayor Jones presented certificates to the graduates of the City’s first Citizen Academy: Dan Sidoti, Marie Holt, Mike Scott, Juna Lee Latamore, Gloria Turner, and Amy Krakowsky.: Mayor Jones read the proclamation designating May 15 as Police Officer Memorial Day and May 13-19 National Police Week. Chief of Police Jim Biederman presented Certificates of Appreciation to Jeff Mueller, Andrew Morman, and Jeff’s parents John and Beal Mueller, for their brave and quick participation in attempting to put out the fire at 929 Shandra Drive on March 10, 2001. Chief of Police Biederman said their actions saved substantial property damage and possible serious physical injury or death of the occupant.
