The meeting was called to order by Mayor Jones at 7:00 p.m.

The Pledge of Allegiance was given.

The Minutes of the June 25, 2001 Board of Aldermen meeting were submitted for approval. Mayor Jones amended the Closed session portion of the Minutes to show reconvening into open session after the City Administrator performance review. Mayor Jones also amended the Report of the Mayor as follows: Plans are available for anyone who would like to see them at the Chesterfield City Hall and by contacting Mayor Jones.

BILL # 3105

- AN ORDINANCE AMENDING CHAPTER 6, ARTICLE II, SECTION 6-28 OF THE CODE OF ORDINANCES ENTITLED "DUTIES" WITH RESPECT TO THE BALLWIN DAYS COMMITTEE.

A motion was made by Alderman Suozzi and seconded by Alderman Buermann for a first reading of Bill No. 3105. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Bill No. 3105 was read for the first time.

A motion was made by Alderman Nichols and seconded by Alderman Robinson for a second reading of Bill No. 3105. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Bill No. 3105 was read for the second time.

A roll call was taken for passage and approval of Bill No. 3105 with the following results: Ayes – McDowell, Suozzi, Easter, Buermann, Boland, Robinson, Nicholsl . Nays – None. Whereupon Mayor Jones declared Bill No. 3105 approved and it became Ordinance No. 01-47.

BILL # 3106

- AN ORDINANCE AMENDING CHAPTER 15, SECTION 15-6 OF THE CODE OF ORDINANCES OF THE CITY OF BALLWIN, ENTITLED "OPERATION OF MOTOR VEHICLE WITHOUT PROPER LICENSE PROHIBITED" BY THE ADDITION OF LANGUAGE REGARDING INTERMEDIATE DRIVER’S LICENSES.

A motion was made by Alderman Boland and seconded by Alderman Buermann for a first reading of Bill No. 3106. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Bill No. 3106 was read for the first time.

A motion was made by Alderman Robinson and seconded by Alderman Nichols for a second reading of Bill No. 3106. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Bill No. 3106 was read for the second time.

A roll call was taken for passage and approval of Bill No. 3106 with the following results: Ayes – Nichols, Buermann, Boland, Suozzi, McDowell, Easter, Robinson. Nays – None. Whereupon Mayor Jones declared Bill No. 3106 approved and it became Ordinance No. 01-48.

BILL # 3107 - AN ORDINANCE AMENDING CHAPTER 15 OF THE CODE OF ORDINANCES OF THE CITY OF BALLWIN BY THE AMENDMENT OF SECTION 15-5 TO INCLUDE MOTORIZED SCOOTERS.

BILL # 3108

- AN ORDINANCE AMENDING CHAPTER XV OF THE CODE OF ORDINANCES IN THE CITY OF BALLWIN BY THE AMENDMENT OF SECTIONS 15-5 TO INCLUDE MOTORIZED SCOOTERS, AND 15-6 DEALING WITH LICENSES.

City Attorney Lucchesi said this bill is a duplication of Bill #3107 and should, therefore, be removed.

A motion was made by Alderman Robinson and seconded by Alderman Buermann to remove Bill #3108 from the records. A voice vote was taken with a unanimous affirmative result and the motion was declared passed.

BILL # 3109

- AN ORDINANCE AMENDING CHAPTER 17, ARTICLE 2 OF THE CODE OF ORDINANCES OF THE CITY OF BALLWIN, ENTITLED "OFFENSES AGAINST PUBLIC PEACE" BY ENACTMENT OF A NEW SECTION 17-31 ENTITLED DISTURBING THE PEACE IN THE CITY OF BALLWIN.

A motion was made by Alderman Buermann and seconded by Alderman Easter for a first reading of Bill No. 3109. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Bill No. 3109 was read for the first time.

A motion was made by Alderman Suozzi and seconded by Alderman Buermann for a second reading of Bill No. 3109. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Bill No. 3109 was read for the second time.

A roll call was taken for passage and approval of Bill No. 3109 with the following results: Ayes – Easter, Robinson, Boland, McDowell, Suozzi, Buermann, Nichols . Nays – None. Whereupon Mayor Jones declared Bill No. 3109 approved and it became Ordinance No. 01-50.

- AN ORDINANCE AMENDING CHAPTER 18 OF THE CODE OF ORDINANCES OF THE CITY OF BALLWIN WITH RESPECT TO GOLF COURSE FEES.

A motion was made by Alderman Robinson and seconded by Alderman Easter for a first reading of Bill No. 3110. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Bill No. 3110 was read for the first time.

A motion was made by Alderman Nichols and seconded by Alderman Suozzi for a second reading of Bill No. 3110. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Bill No. 3110 was read for the second time.

A roll call was taken for passage and approval of Bill No. 3110 with the following results: Ayes – Suozzi, Easter, Boland, McDowell, Nichols, Robinson. Nays – Buermann. Whereupon Mayor Jones declared Bill No. 3110 approved by a vote of 6-1, and it became Ordinance No. 01-51.

by Alderman Nichols and seconded by Alderman Robinson to approve the consent items. A voice vote was taken with a unanimous affirmative result and the motion was declared passed.

REPORT OF THE MAYOR

Mayor Jones explained that Alderman Huddleston resigned his position due to moving out of state. In accordance with the fourth class city statutes of the State of Missouri, Mayor Jones reecommended the appointment of Charlie Gatton to fill the unexpired term until the next general election. If the Board approves, Mr. Gatton would be sworn in on August 27, 2001, with the term ending on April, 2002 at the next general election.

by Alderman Nichols and seconded by Alderman Easter to approve the appointment of Charlie Gatton as Alderman in Ward 4, due to the resignation of Alderman Huddleston. A voice vote was taken with a unanimous affirmative result and the motion was declared passed.

REPORT OF THE CITY ADMINISTRATOR

New Ballwin Road

– City Administrator Kuntz reported that Holy Infant Church has concerns about the issue of the closure of the existing curb cut which is southerly before reaching the intersection with Dennison. Since the design is still in the concept stages, he suggested holding a public informational meeting to solicit more input and feedback.

– City Administrator Kuntz gave an update on the park improvements and budget status.

– City Administrator Kuntz requested a motion for certain Board meeting cancellations for 2002 to be indicated on the Ballwin calendar, as follows: The first meeting in July and August, Memorial Day, and the meeting 2 days before Christmas.

Cash flow

– City Administrator Kuntz reported that there will be a cash flow issue in our capital budget as a result of time lags caused by Federal reimbursements. He indicated that it will be necessary to make temporary transfers from the operating fund to cover these expenses..

Retreat

– City Administrator Kuntz said this is for the purpose of addressing some immediate issues that would take a lot of time away from a regular meeting. Another would be a half-day planning retreat after the holidays for future planning. by Alderman Buermann and seconded by Alderman Nichols to approve the transfers for cash flow for the reimbursable federally funded projects. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. by Alderman Boland and seconded by Alderman Nichols to cancel the first meeting in July and August, Memorial Day, and the meeting 2 days before Christmas, 2002, and have these cancellations shown on the Ballwin calendar. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. by Alderman Buermann and seconded by Alderman Boland to proceed with the plan with the addition of the fishing piers in the upper lake at an additional cost of $22,000, and accept the Gershenson Construction bid of $289,137. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. by Alderman Nichols and seconded by Alderman Suozzi to present to the public that the Board of Aldermen have developed a conceptual plan, as outlined, and then present it to the public for their comments at a date yet to be determined. This would be coordinated by St. Louis County. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. by Alderman McDowell and seconded by Alderman Easter to endorse the proposed plan for New Ballwin Road. A voice vote was taken with a unanimous affirmative result and the motion was declared passed.

- Alderman Boland thanked and complimented the individuals who addressed the Board during "Citizen Comments". He said this is a necessary and informative way to know what the citizens are thinking. - Alderman Nichols reported that a letter was sent to all the residents on Henry Road explaining that Henry Road will be transferred to St. Louis County for the purpose of maintenance. He said he is unaware of any active discussions with St. Louis County to give them Henry Road. He and Alderman Robinson are opposed to any widening or major change to this roadway. - Alderman McDowell inquired about temporarily closing Woerther for a week until the construction is finished. City Administrator Kuntz said this was done today.

The motion passed unanimously and the meeting was adjourned at 9:00 p.m. by Alderman Robinson and seconded by Alderman Nichols to reconvene into open session. A roll call was taken with the following results: Ayes – Buermann, Suozzi, Boland, Robinson, Nichols. Nays – None. Whereupon Mayor Jones declared the motion approved and the closed session was adjourned at 8:57 p.m. by Alderman Buermann and seconded by Alderman McDowell to convene into closed session to discuss pending litigation. A roll call vote was taken as follows: Ayes: McDowell, Suozzi, Buermann, Boland, Easter, Robinson, Nichols. Nays: None. Mayor Jones declared the motion passed and the meeting was adjourned to closed session at 8:36 p.m.

 

Alderman Nichols amended section (a) to read "which the rider normally stands".

A motion was made by Alderman Buermann and seconded by Alderman Boland for a first reading of Bill No. 3107, as amended. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Bill No. 3107 was read for the first time.

A motion was made by Alderman Nichols and seconded by Alderman Boland for a second reading of Bill No. 3107. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Bill No. 3107 was read for the second time.

A roll call was taken for passage and approval of Bill No. 3107 with the following results: Ayes – Buermann, Nichols, McDowell, Easter, Robinson, Suozzi. Nays – Boland. Whereupon Mayor Jones declared Bill No. 3107 approved by a 6-1 vote and it became Ordinance No. 01-49.

by Alderman Nichols and seconded by Alderman Buermann to refer this issue to the Public Health and Safety Committee for further consideration for a recommendation to the Board as to further amendments may be required. A voice vote was taken with a unanimous affirmative result and the motion was declared passed.

: Mr. Goetz asked if the motorized scooters are allowed to be operated in the Ballwin parks. He also spoke in favor of allowing children to push motorized scooters to an area where they can use them legally.: Ms. Pollnow spoke in favor of looking out for the children on motorized scooters and in support of the ordinance.: Ms. Florsek spoke in favor of the Police Amendment ordinance for the 2-wheel motorized scooter. She also suggested a skate board park be built in Ballwin.
