MINUTES OF THE PLANNING AND ZONING COMMISSION MEETING
CITY OF BALLWIN – 300 PARK DRIVE
April 2, 2012

The meeting of the Planning and Zoning Commission was called to order by Chairman Michael Wind at 7:02 p.m.  Members in attendance were:

Approval of Minutes

A motion was made by Mayor Pogue and seconded by Secretary Karr to approve the minutes of the Feb-ruary 6, 2012 meeting of the Planning & Zoning Commission as submitted.  The motion received unani-mous approval from the Commission members present.

  Petitioner:  Mr. James Robinson VP, FSP-Ballwin LLC, 1075-A Powers Place, Alpharetta GA  30009 

Mr. Cliff Stanfield of FSP-Ballwin LLC addressed the Commission, requesting approval for the zoning change.  He said the footprint of the existing building will not change.  Because of great interest in the facility, the petitioner would like to amend the plan to create an additional living space where originally the plan called for a staff lounge.  Mr. Stanfield stated that there is already a staff lounge/break room lo-cated on the first floor.  During construction, the interior space was retrofitted so that the space can be easily converted to a dwelling unit. 

Mayor Pogue said he feels this is an easy decision, as there is no change to the exterior or the site plan.

Chairman Wind opened the public hearing and asked if there were any opponents who wished to speak in opposition to Petition Z 12-01.  There were none.  Chairman Wind asked if there were any proponents wishing to speak in favor of the petition.  There were none, and Chairman Wind declared the public hear-ing closed.

Mayor Pogue made a motion to recommend approval of Petition Z 12-01 to the Board of Aldermen.   Alderman Fleming seconded the motion, which received unanimous approval from the Commission mem-bers present.

Other Business

City Planner Aiken noted that construction on the cell tower in New Ballwin Park has been completed.  The difference is not very noticeable.  There are no items for the May agenda, so no meeting will be held.

Mr. Aiken noted that Ballwin Grove retail center is close to completion.  Two new restaurants plan to be open in late June, and will have patios that look out over the pond.  Chairman Wind said he likes the de-sign of the buildings in Ballwin Grove.

Secretary Karr asked City Planner Aiken to share information with the Commission regarding the U-Gas meeting.  Mr. Aiken said that U-Gas has elected to pursue a TDD (Transportation Development District) in conjunction with the project at the corner of Seven Trails Drive and Manchester Road.  U-Gas peti-tioned the court, and a hearing was held.  The matter will now go back to court.  If the court determines that all the statutory prerequisites have been met, it will allow the creation of the TDD, and establish a tax district wherein a sales tax will be imposed in U-Gas and Wendy’s on sales inside the buildings.  The TDD will be in effect for 25 years.  The City of Ballwin, MoDOT, and St. Louis County have all indicated they do not oppose or support the formation of the TDD.  City Attorney Jones said he asked if there would be any lane closures during the road improvements, and the response was that there will not be full lane closures, but there may be single lane closures.  The work is expected to be completed by the end of July.

City Planner Aiken said CAP Carpet is moving along.  Judging by the current construction schedule, they will probably be ready to occupy by the end of July.

A motion was made by Commissioner Goetz and seconded by Mayor Pogue to adjourn the meeting.  The motion received unanimous approval, and the meeting was adjourned at 7:15 p.m.
