Approval of Minutes
A motion was made by Alderman Kerlagon and seconded by Commissioner Utt to approve the minutes of the September 6, 2016 meeting of the Planning & Zoning Commission as submitted. The motion received unanimous approval from the Commission members present.
SUE 16-08 Special Use Exception –Sale of Alcoholic Beverage by the Drink for Consumption on the Premises Where Sold

Petitioner: Mr. Douglas Druen, 6040 Dutchmans Lane, Louisville KY 40205
Mr. Paul Phillips, Senior Development Coordinator for Greenberg Farrow (site engineer and architect) addressed the Commission on behalf of the petitioner, requesting approval for the special use exception.
Alderman Kerlagon asked if Texas Roadhouse will have the same format as Senor Pique, which currently occupies the space. Mr. Phillips said it will be very similar to what is on the site today.
Chairman Weaver opened the public hearing for Petition SUE 16-08, and asked if anyone wished to speak in favor of the petitions. No one came forward. Chairman Weaver asked if anyone wished to speak in opposition to the petitions. No one came forward, and Chairman Weaver closed the public hearing.
City Administrator Hanson asked about the process timeline for the proposed development. Mr. Phillips said once the petitioner has board approval for the alcohol sales, the lease agreement will be signed, and the process of submitting permits will begin. The petitioner anticipates beginning construction in January 2017 as weather permits, with a four-month build time. The restaurant would then open for business in late April or early May.
Chairman Weaver asked if the petitioner will use the existing building. Mr. Phillips said no. The existing building will be torn down and replaced with a new building. Chairman Weaver asked if that will come before the Planning & Zoning Commission again. City Attorney Jones said it will only come before the Planning & Zoning Commission if there is an amended site plan.
Chairman Weaver made a motion to send a positive recommendation for Petition SUE 16-08 to the Board of Aldermen. Alderman Kerlagon seconded the motion. The motion received unanimous approval from the Commission members present.
Other Business
Chairman Weaver asked if there is anything on the agenda for November. Code Enforcement Supervisor Klein said there may be a subdivision petition for a site on Reinke Road.
Alderman Kerlagon asked on behalf of Frank Karr if there is an updated zoning map of the City. Mr. Klein said it is on the horizon, but has not been started. City Administrator Hanson said that part of the consideration is that it has been 10 years since the last Comprehensive Plan was created. Mr. Hanson said that will be a project in the next 24 months for the person who will fill the vacancy left by Tom Aiken’s retirement.
Adjournment
Commissioner Young moved to adjourn the meeting. Alderman Kerlagon seconded the motion, which received unanimous approval from the commission members present. The meeting was adjourned at 7:09 p.m.
